Welcome to Hartley Daylesford. By accessing our website and placing an order, you agree to be bound by the following Terms and Conditions. Please read them carefully before making a purchase. Your purchase is protected under the Australian Consumer Law (ACL), the Competition and Consumer Act 2010 (Cth), and other applicable federal and state consumer protection laws.


1. PRODUCT INFORMATION

  • We aim to display and describe all products as accurately as possible.
  • Colours may vary slightly due to screen settings or lighting.
  • All prices are listed in AUD and include applicable taxes (including GST where applicable).
  • Promotions and special offers are valid while stock lasts or for the duration of the promotion.

2. ORDERING AND PAYMENT

  • Orders can be placed directly through our website.
  • We accept the following payment methods: Visa, Mastercard, Apple Pay, Shop Pay, Google Pay, Maestro and Afterpay.
  • Your order is processed once the payment has been successfully received.
  • In case of obvious pricing errors, stock inaccuracies, or incorrect product information, we reserve the right to cancel or adjust the order.

3. SHIPPING AND DELIVERY

  • Delivery within Australia typically takes 7–14 working days, depending on your location.
  • Order processing time is 1–3 working days. Orders placed on weekends or public holidays are processed on the next business day.
  • We offer free shipping on all Australian orders.
  • We are not liable for delays caused by couriers, natural events, or peak-season congestion.
  • Once your order has been shipped, you will receive a confirmation email (including tracking details if available).

4. RETURNS & REFUNDS (AUSTRALIAN CONSUMER LAW)

In accordance with the Australian Consumer Law (ACL) under the Competition and Consumer Act 2010 (Cth):

  • You may return full-priced items within 30 days of receiving your order.
  • Items must be unused, unwashed, and in original condition, including tags and packaging.
  • Once we receive and inspect your return, refunds are issued within 7–14 business days to your original payment method.

5. EXCEPTIONS TO RETURNS

The following items cannot be returned unless they are faulty:

  • Underwear or swimwear where hygiene seals have been broken.
  • Items returned in worn or damaged condition.

6. FAULTY OR INCORRECT ITEMS

Under the Australian Consumer Law (ACL):

  • You are entitled to a replacement or refund for faulty goods, and compensation for any other reasonably foreseeable loss or damage.
  • If you receive a faulty or incorrect item, please notify us within 48 hours of delivery at support@hartleydaylesford.com.
  • We will cover return shipping costs for faulty or incorrect items.

7. LIABILITY

  • We are not liable for indirect loss, consequential loss, or loss of profits.
  • This does not limit your rights under the Australian Consumer Law (ACL) or the Competition and Consumer Act 2010 (Cth).
  • Nothing in these Terms excludes liability for negligence, fraud, or any rights that cannot be excluded under Australian law, including the consumer guarantees provided under the ACL.

8. FORCE MAJEURE

We are not responsible for delays or failure to deliver due to circumstances beyond our control, including (but not limited to): natural disasters, courier disruptions, strikes, system outages, or severe weather conditions.


9. GOVERNING LAW

These Terms and Conditions are governed by the laws of the State of Victoria and the applicable federal laws of the Commonwealth of Australia.

Any disputes will first be addressed through direct communication and good-faith resolution efforts. If a resolution cannot be reached, disputes will be handled by the competent courts of Victoria, Australia. Consumers in Victoria may also seek assistance from Consumer Affairs Victoria or the Australian Competition and Consumer Commission (ACCC).

Nothing in these Terms limits your statutory rights under the Australian Consumer Law (ACL) or any other applicable consumer protection legislation.
